BRIONY KENNEDY — TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of the Briony Kennedy website (brionykennedy.com.au) and the services we provide. By using the site or engaging our services, you agree to these Terms.

1. ABOUT US

BrionyKennedy.com.au and the Briony Kennedy services are operated by Briony Alexandria Kennedy, a sole trader based in Melbourne, Victoria, Australia (ABN 46 973 308 349). The Buy Guide is the registered business name. Contact: letstalk@brionykennedy.com.au.

2. SERVICES PROVIDED

We offer:
- Consulting, advisory, and strategy services
- Live commerce hosting
- UGC and content creation
- Workshops, speaking, and brand partnerships
- Digital resources and future memberships

Specific terms for each engagement are set out in individual service agreements or invoices.

3. ACCOUNTS

You may need to create a customer account to access certain content and services. You agree to:
- Provide accurate information
- Keep your account credentials secure
- Notify us immediately of any unauthorised access
- Not share your account access with others

We may suspend or terminate accounts that breach these Terms.

4. INTELLECTUAL PROPERTY

All content on this site — including text, images, video, frameworks, templates, and downloadable resources — is owned by Briony Alexandria Kennedy or licensed to us, and protected by Australian and international copyright law.

You may:
- View, download, and print content for your own personal or internal business use
- Share links to public pages

You may not:
- Reproduce, republish, resell, or distribute our content
- Use our content to train AI models
- Use our brand name, logo, or likeness without written permission
- Reverse-engineer or copy our methodologies for resale

5. USER CONTENT

If you submit content (testimonials, enquiries, comments), you grant us a non-exclusive, royalty-free license to use it for promotional or business purposes. You confirm the content is your own and doesn't infringe anyone else's rights.

6. DISCLAIMER OF WARRANTIES

The content on this site is provided for general information and educational purposes only. It does not constitute personalised business, financial, or legal advice. We make no warranties about the accuracy, completeness, or suitability of the content for your specific business.

Engagements for personalised advice are governed by separate service agreements.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by Australian law, Briony Alexandria Kennedy is not liable for:
- Indirect, incidental, or consequential losses
- Lost profits, revenue, or business opportunities
- Damages exceeding the amount you paid us for the relevant service

Nothing in these Terms limits any rights you have under the Australian Consumer Law (ACL) or other applicable laws that cannot be lawfully excluded.

8. One-off session bookings, cancellations and rescheduling

Cancellations and rescheduling require at least three full business days’ notice, excluding weekends and public holidays observed in Melbourne. Preparation starts before your call. Late changes or missed appointments may incur reasonable preparation and unrecoverable costs, up to the service fee, after allowing for costs saved or a replacement booking.

Email letstalk@brionykennedy.com.au to request a change. Read the full booking and cancellation terms. Your Australian Consumer Law rights remain unchanged.

For new one-off virtual session and review bookings made from 29 October 2026, the Booking & Cancellation Terms form part of your booking agreement. They replace any older 24-hour cancellation rule for those bookings. Other separately agreed engagements retain their specific terms. Nothing in these terms limits rights that cannot lawfully be excluded.
